This advanced planning law course addresses some current substantive topics in land use law as well as exploring some themes that tend to emerge repeatedly in land use litigation. Substantive topics will include: zoning for rental tenure, affordable housing and special needs housing; people zoning; inclusionary zoning; prohibition of land uses; lawful non-conforming uses (what does “lawfully used” actually mean?); dealing with the Province (issues with overlapping jurisdiction); CACs, PDAs and density bonuses. Themes to be discussed include judicial deference to local elected officials (the test of reasonableness); procedural fairness in the digital age; zoning bylaw interpretation approaches.
